Luna to turn investigation of Palmdale traffic stop over to FBI

PALMDALE  – The FBI will join local prosecutors in investigating a Los Angeles County Sheriff’s Department deputy from the Palmdale station throwing punches at a woman while she cradled her baby during a traffic stop that took place in July 2022, the department announced.

In the video, a male deputy is shown throwing two overhand punches at the woman as she is seen pleading not to take her baby away.

“I found the punching of the woman and the circumstances completely unacceptable,” Sheriff Robert Luna said, after releasing body camera video footage of the traffic stop. [Download and view the LASD bodycam footage here.]  [View video of the LASD press conference addressing the video here.]

Luna said he took the “swift action” of  relieving the deputy of duty after finding out about the incident a few days ago. Luna said the traffic stop occurred just before midnight on July 13, 2022, when deputies from the Palmdale Sheriff’s Station noticed  a vehicle driving at night without the headlights on, the Los Angeles Times reported.

When they pulled over the driver, the deputies noticed the smell of alcohol coming from inside and saw four women, three of whom were holding babies in their arms instead of using car seats, according to The Times. The deputies arrested the man driving the vehicle on suspicion of felony child endangerment, as well as driving under the influence and driving with a suspended license. The women were arrested on the same charges but during the course of arresting them deputies used force with two of them.

On the video released Wednesday, July 12, the deputies can be heard saying that the woman was riding in a car driven by someone without a valid license and that her baby was not in a car seat. They repeatedly asked the woman who was eventually struck in the face to give up the child so she can be placed under arrest, telling her  that her infant will be pulled away otherwise.

“Forcefully taking your child from you is not what’s best,” one deputy said. “Taking my child from me is not what’s best,” the woman replies.

After several minutes of back-and-forth, the deputies pulled the woman’s hands apart and she began screaming as the child was taken away. Another woman who is close by and holding a baby begins screaming and cursing at officers. When deputies state they plan to arrest her as well, she becomes incensed.

“Y’all gonna have to shoot me dead to take my baby from my arms,” she says before a struggle with deputies ensues. During the confrontation, a male deputy is seen throwing two punches at the woman’s head while she is still holding her baby.

Late Wednesday night, the Association for Los Angeles County Deputies, the union that represents deputies, released a statement saying the video does not tell the entire story about the traffic stop.

“The video makes one thing obvious — police work is demanding and unpredictable. Any dispute over the control of infants on the roadway at 12:30 a.m. during an arrest of the driver of the car these children were riding in without proper restraints is a bad situation. Apparently, our deputies and the on-scene patrol supervisor had determined it wasn’t safe for the children to leave with the parents who were going to be taken into custody,” wrote ALADS President Richard Pippin.

“The physical safety of the infants was clearly our deputies’ highest priority as they were seen pleading with the women for a lengthy period. There will be a lot of Monday morning quarterbacking, and some will no doubt say that things could have been done differently. We will let the public decide that for themselves.”

Fifth District County Supervisor Kathryn Barger, who represents Palmdale on the Los Angeles County Board of Supervisors, called the video “gut- wrenching. My heart aches for the children that we see in this video and for their mothers,”

Barger added, “To the law enforcement community who will also see this video today and whose work will be judged harshly in the court of public opinion, I want you to know that I value your work.”

Fourth District Supervisor Janice Hahn called for Luna to fire the deputy who threw the punches.

“It is appalling and there is no justification for this violence,” Hahn said in a statement. ” This deputy does not belong in our Sheriff*s Department.”

“I’m disturbed and horrified by the footage that LASD released showing mothers in distress who simply needed help keeping their children safe. These women and their children needed a safe ride home; instead, those sworn to protect them inflicted physical harm [and]  lasting trauma” said Third District Supervisor Lindsay Horvath.

Holly Mitchell, who represents the Second District, said, “The body cam footage Sheriff Luna released of a male deputy using excessive force during an interaction with a Black woman and her infant is shameful. This footage is further indication of the need for a culture shift that ends the long history of brutality directed towards Black people and communities of color by law enforcement.”

“These acts of violence cause immeasurable harm and I expect zero tolerance for this behavior. I want to thank Sheriff Luna for working towards increased transparency and accountability in the department,” Mitchell said.

The confrontation took place during the tenure of former Sheriff Alex Villanueva, who lost his reelection bid to Luna after a contentious campaign. In a statement  to The Times, he called Luna’s statements “extremely disingenuous” and said he hadn’t taken action to terminate the deputy before leaving office because the investigation into the matter had not concluded.

“Furthermore, the only reason action was taken today was because the statute of limitation was about to expire tomorrow, July 14,” Villanueva said. “His presser deliberately excluded all footage that showed the struggle to remove the infants from the custody of the suspects who endangered their lives, and the context of the deputy’s decision to use force. That very context will most likely preclude any criminal proceedings that would lead to a conviction, so this is nothing more than political posturing.”

Luna said he could not “speak to what my predecessor did or did not do. The action I am describing to you today is action that I took in the last couple of days.”

The release of the video occurred against the backdrop of a June 24 confrontation  when deputies responded to 911 calls for a reported robbery in progress at a WinCo Foods grocery store on Avenue K in Lancaster. After arriving on scene, they encountered a man and a woman who allegedly matched the description of the suspects given to 911.

As the deputies handcuffed the man in the parking lot, the woman began filming with her phone. Within seconds, one of the deputies rushed toward her and reached for her arm, seemingly in an attempt to take the phone. The woman was thrown to the ground and pepper-sprayed by a deputy.

Driving at midnight with no lights on, driving with your kids on your lap and drunk driving on top of that. People are actually sympathetic to these terrible mothers. Tim has invited me to meet him in the past, I simply can’t put myself in a situation where I’m going to be video recorded, I’m not interested in a twink hook up either. Never trust a con man. He may have paid some debt to the legal system, but he is a thief.

  2. I think the real question here that should be explored is what was the destination of travel ie: errand, that justified 3 baby’s without car seats with Mr happy behind the wheel.
    A. Trip to the emergency room
    B. A run on baby formula
    C. Going to beat the hell out of my baby daddy’s side piece
    D. Local smoke shop
    This answer determines wether those moms need to get some counseling. If that deputy just lost it after dealing with years of bulls**t up here then he needs counseling to.

  6. For those who don’t know, Tim Scott is a convicted felon who did years behind bars for bank robberies. He wrote a book on it and capitalized on his criminal exploits while trying to sell his transgressions against society as a personal path to self discovery. Tim says he has rehabilitated himself, but as many of you have commented, he has learned nothing and has changed nothing about his character, as evidenced by his pure disdain for decency, accountability, and the laws that govern our society. He does have a talent for twisting facts and contorting reality and has managed to gather a loyal band of misfits on this site who gag at the opportunity to be his white knight and defend him.   7. Ordinary people are ignorant and judge these encounters based on their instant emotional response. Their perceptions are usually totally based on how they feel without giving due consideration to what the laws actually state.

    Graham v Connor is a landmark US Supreme Court case in this country that is the standard by which every use of force by police is judged. Alex Villanueva is very correct in his assessment. This investigation is dead in the water and will never make it to court. It is a clear cut case of justifiable force. While it is ugly it is legal. Just remember, these loving mothers are the ones who risked the lives of those innocent children to begin with. But you are all more than likely far too ignorant or emotionally jaded to understand this concept.

  8. It’s amazing what less than 5 seconds of video can bring out in a multi minute bad situation. There is one thing that’ll give that deputy a free pass, if she was trying to bite any of those other deputies. Pepper spray would not be a prudent tool considering that baby, spitting and especially biting are considered serious weapons, ask any first responder that has to be tested for months to years.

          Well, to date I have six people who are at varying places on the spectrum between acquaintance and friend that I met through this comments section. Too many meet for coffees and lunches to keep track of with them. Then there’s one cute girl that wanted to meet me. Three people that wanted me to sign a book for them.     • There are many cops who are fair and balanced mentally. The problem in Lancaster is there is a culture of bullying that comes from the mayor and vice mayor and filters into the culture. When all you hear is war on this, war on that, put guns on streetlights, hang ’em, you’re a ‘gang’ candidate, kill the pit bulls, get out of this council meeting, etc., you get away from protect and serve the public and the focus is to protect and serve the interests of the good old boy networks. That’s how it’s been in Lancaster for decades and that’s why Lancaster is the armpit of the AV. Even Rosamond isn’t as dysfunctional as Lancaster.

  11. Law enforcement officers, like the deputies in this news article, are human and not perfect, but they are out there 24/7, doing a tough job and yes, they make mistakes just like anyone else. But overall, the deputies and officers are decent, hard working people doing a tough job and dealing with difficult people and situations every day. Now, whoever Tim Scott is, he has zero credibility. No matter what story he is commenting on about law enforcement, his comments are extremely negative and just what you would expect from someone who has an obvious dislike for law enforcement. I wonder why? Maybe he has lots of experience looking at law enforcement from INSIDE the jail cell? Regardless, we all get what this fool is about. He would be happy with NO law enforcement in the community to protect citizens from himself and others who would be free to do what they do best, laughing because there would be no protectors around to stop the criminal elements who prey upon and victimize society.

I have, however, seen consistent lawlessness, violence, gang banging, and hedonism coming from the black community. Nobody is ever scared to step foot in a white neighborhood, are they?         • Eve, I have to disagree. I have seen Peckerwoods, SWPs and other white supremist groups in the AV. In LA, there were sundown towns. To be fair, I have also seen black, Hispanic and Asian gangs. So if you look at it in its entirety, there are thugs of all races. I don’t like thugs no matter what group they belong to.

  12. It is not difficult. Sheriffs and officers wear body cameras now. They can get in big time trouble if they turn them off. So, if you are stopped by law enforcement, shut up, do what they want, show I.D., and it will be okay. If you have messed up or am drunk, you are going to jail. Don’t add resisting arrest or battery to the charge. Write this down if you don’t understand or are dumb to remember this.

  13. This deputy made a decent decision. I don’t agree with or like LASD but I call it like I see it and this isn’t that bad. I don’t have a issue with honest law abiding law enforce but I think that is extremely rare and even more rare once a deputy gets personally involved in your situation, like getting hurt, unlawful use of force, crash’s his or her car on a code 3 call as the one authorized to be lights and sirens and the backup because two at fault accidents and they aren’t the solo cowboy no more and must have a partner and can’t drive so say nothing if you get in a accident and get a lawyer. Try hard to be respectful and stay quiet. You can’t talk to a pig about your business. So try to fly under their radar or suffer the consequences.

        • You don’t have to blindly follow the orders of anyone in authority, but the fact is the officers were giving GOOD instructions to people making very bad decisions. Drinking and driving is dangerous for everyone involved, including those babies, and the innocent people trying to make it home safely to their families. These women weren’t acting like mothers, and they weren’t protecting their own children. With those facts stated, your comment has no grounds. Only fools despise correction.

          • The question isn’t “were the instructions good?” The things that matter are “were the instructions given within the legal boundaries we put around the people who are entrusted with the authority of a badge?” “Did the officers respond in a legal manner to being disobeyed?” Most officers are aware that “I was disobeyed so I pulled out my gun and shot them” isn’t a legal option. Most also know that “I was disobeyed so I punched her in the face” is also not a legal option.

    • Dishonesty is the core value of the Lancaster and Palmdale sheriff’s stations. It’s only now that they have cameras that we see “some “ of what’s happening. Just imagine what they were doing before cameras. How many people were killed and beaten unlawfully before cameras and we have all of those that got away with their dishonest behavior. But now technology is busting you piglets. LASD as dishonest as can be.

    • The mess are the people who have no care or concern for the well being of themselves, their own families, nor the community at large. We should not lower or standards of living because some people choose to live destructive lifestyles. Corruption runs two ways. You don’t have to be in a position of authority to be parasitic.       • Yes there are many people who have no care or concern for the well being of others here in Lancaster. But we also have leadership that has been failing us for decades. Rather than engaging with the community, they have chosen bullying and the “my way or the highway” approach to just about everything. Does anyone ever wonder why crime is lower in Palmdale than Lancaster? They are identical in terms of demographics. They are very different in their approaches to crime and community policing (or at least they were until Palmdale was taken over by Lancaster) .

        • Palmdale and Lancaster are not “identical” in their demographics — not by a long shot!

          Palmdale has a lower crime rate because it has a larger population of educated people. It also has more working class families and less people using welfare, which is why the median household income is higher in Palmdale than in Lancaster.

  17. There would have not been any punches if the women just complied and took their rightful punishment and allowed themselves to be arrested. Do I think she deserved to be punched…no, But does law enforcement need these situations to be escalated by foolish people, also no. If you play stupid games you win stupid prizes.

    • Actually trying to bite apprehending deputies trying execute a felony arrest. News flash to the Timmy mob, that deputy is within the law. If he were to use pepper spray that would have impacted the baby. Even lethal force can be applied if there is any form of a life threatening action by a subject. Could deputies backed off created some distance and waited her out possibly, possibly not, most likely not. They can barely cover shooting calls at that hour in Palmdale let alone Lancaster. The routine call is extinct up from 5pm to 4am every night.

        Given the millions of miles traveled compared to the (admittedly too high) number of accidents it is absurd to claim that there was a ‘likelihood of great bodily harm.’ Is holding a baby on your lap a stupid and needless risk? Sure. Does it carry a high probability? No. So pulling a ‘felony child endangerment’ charge out of their butts was an absurd reach by the cops.

        So we have cops making up charges that ‘justify’ violent attack on a citizen, then escalating when their first wave of shock and awe assault meets terrified resistance. Crack open your taxpayer’s money checkbook AGAIN LA County, because once again a cop will cost you millions while suffering no personal consequences whatever.

        • What made it a felony child endangerment is that they made the choice of getting into a vehicle with an intoxicated driver full well knowing they were putting those babies at extreme risk not having car seats, which is a law for infants by the way. Some of your comments here are pretty ignorant. The public and those babies are lucky this driver didn’t run as many DUI’s do.

          • Bull. Millions of accident free miles are driven every day. “Likelihood of great bodily harm” is not created by a one time bad decision. There on the side of the road there was no established pattern of behavior. I’m not arguing that kids in cars without car seats is a good thing, but there was no grounds for making the “felony arrest’ that you claim as justification for the thuggish violence the cops resorted to, which was just based on “I am offended that you disobeyed me so you must pay.”

            So, we have one person, the driver, who can be cited for a vehicle coda violation. The driver gets pulled over and there is probable cause for a field sobriety check on him, leading to a felony dui arrest…of HIM. The passengers have violated the vehicle code because they have kids and no car seats. Issue citations and tell them when they call for new rides be sure that there are car seats, end of story.

            But no, thugmaster starts waving his badge and making illegal demands. Next thing you know, there’s a woman holding a baby getting punched in the face. And the end of the story becomes yet another multi-million dollar lawsuit against the county while the thug suffers no consequences.

They put their kids in danger, and were being arrested for doing so. I know this was a messed up situation for them, but you got caught being a bad parent, and committing a crime, therefore you have to go to jail and be without your kids.           • How my book is marketed works out really well for me. I like having something to sell. I’ve never had any problem finding people who will pay me to sell their stuff for them, but the whole negotiation of commission part isn’t fun. Writing a book also isn’t fun, but with that part out of the way it’s all good from here on.
