Pretrial hearing continued in Palmdale road rage killing

LOS ANGELES – A court hearing was postponed Monday for a 20-year-old man charged with killing a 62-year-old man after an alleged road rage incident in Palmdale last year, authorities said.

Cody Allen Davis was scheduled for a pretrial hearing in a Los Angeles courtroom that was continued to May 21, according to Sarah Ardalani of the Los Angeles County District Attorney’s Office.

Davis is charged with murder in connection with the death of 62-year-old Alberto Delpino, Ardalani said.

Delpino died Jan. 28, 2014 in Antelope Valley Hospital’s Intensive Care Unit as a result of multiple blunt force injuries.

The Palmdale resident was allegedly attacked in West Palmdale around 5 p.m. Jan. 25, 2014 after a road rage incident, according to sheriff’s officials.

“He accidentally cut this guy off and then the suspect began to follow him. He didn’t want the suspect to follow him home so he stopped at Vicker Way and O-8… [He] got out of the car to apologize and that’s when he was attacked,” Palmdale Community Relations deputy Jodi Wolfe told The AV Times last year.

Delpino went home after the alleged assault, but the 62-year-old was transported the next day to the hospital where he died of his injuries Jan. 28, 2014.

In the days following the alleged assault, Wolfe said detectives were looking for two white males, one thin and one heavyset, who were in a beige or tannish-colored truck.

An indictment returned by a grand jury Sept. 17, 2014, charged Davis with murder in connection with Delpino’s death, Ardalani said Monday. Davis is the only defendant charged with Delpino’s murder, Ardalani added.

LASD inmate records show Davis was arrested Sept. 25, 2014. He remains jailed in lieu of $1 million bail.

    RIP to the victim. It doesn’t matter what your sex preference is you should not be killed by some low life that thinks he is the only one that fits in the road. Cody shall pay with a really long sentence. People like him shouldn’t be free they should stay in jail forever we don’t need people like this.

    Why hasn’t anyone stated the most consistent (and most likely true) rumor around town? This wasn’t just road rage. THIS WAS A GAY BASHING. Obviously, there was road rage involved, but the real trouble started when the gentleman began to speak to the perpetrators. All of these apologist posts are trying in their own, illiterate ways, to steer us clear from the fact that he was chased because he mistakenly cut another driver off, but he was killed because he was gay. I’m just sorry this wasn’t charged by the D.A. the way it should have been,:a murder one hate crime!

      SHAME ON YOU for casting judgement when you weren’t even there. SHAME ON YOU for running with whatever you CHOOSE to read and not research.
      This guy died 3 days later, have you researched drug use, AIDS, Heart problems?? Answer NO because you are above research you just sit there and judge.
      I like to ask everyone who is judging here, If put in a situation when somenone is coming at you are you going to sit there and say ok or are you going to react? EXACTLY! you’re going to react because it is human instinct. Nobody can say what this Delpino was going to do or what happened because you weren’t there. He was 62 years old shouldn’t he of been older and wiser and drove safely in the first place and not confronted anyone in the first place??

          No problemo. That was me using one of ‘moll flanders’ own replies to me to reply back to her.

          She’s the village scold here; never having anything useful to say. Never replying to the specific content of my comments, just stalking as is her customary wont. She does the same with others when I take a day or two off. Too funny.

          So, using her own comments is a way to point out her own hypocrisy to her but I doubt she’ll get it. Will she still call me a ‘bully’ for replying with her own words, you ask? But, of course she will.

          Occasionally, she’ll write something so artificially sweet it draws ants. But, we know what she’s really like. She just keeps revealing it.

          I hope she replies to this comment. I can handle it and I always give back better than I receive, sometimes with humor. It drives her mad, MAD I tell ya.

        I shouldn’t judge but you suggest Mr. Delpino died of AIDS (an incredibly ignorant statement even for a toothless hillbilly like you). Why would you say that?

        Maybe dirtbag Cody Davis following and tailgating Mr. Delpino in his meth fueled road rage and then beating him caused his death, not AIDS or heart disease.

    Alberto (Alex as we knew him in Home Depot) was an awesome individual. Always full of life and happiness! I was devastated when I heard of his passing. He did not deserve this! I hope the jerk that did this gets life in jail. This was a heinous and cruel act because someone “cut you off.” My prayers with his family and his partner. Words cannot describe how awesome he was! Heaven has gained an AMAZING angel!

      Because you are innocent until proven guilty, the prosecution must prove your guilt beyond a reasonable doubt. In other words, once all of the evidence against you is considered, no reasonable person should be able to question your guilt—otherwise, you cannot be found guilty.

        @ ASSUME Pleading the Fifth is a colloquial term for invoking the privilege that allows a witness to decline to answer questions that might incriminate him or her, without penalty or it counting against him or her.

        I was thinking the same thing. Why did he pull over. That’s rule #1 don’t ever get out of ur car, especially if someone is following you. It’s a horrible crime and my condolences are to the victim and his family.

          He got out of the car to apologize to the people. My coworker (who also knew him personally) was driving directly behind him when everything happened. She stated the guy was trying to run him off the road. He stopped to apologize and got beaten (to far to repair) bad enough die the next day. She had already called police and they were in route to where the chase(yes they chased Alberto while trying to run him off the road) was going on. They didn’t arrive in time and Albert was so shaken that he refused medical attention fearing they were going to track him home and further the damage. Otherwise he would have gone to the hospital. He wasn’t thinking not to get out of the car. He wanted to diffuse the situation.

          Innocent until proven guilty is a legal term for the courts and does not apply to public opinion. If we were on a jury or a witness in this case, that would be different.

        One man is dead and the other didn’t have any injuries. That makes it pretty clear. No self-defense if Mr. Davis wasn’t injured.
